Statement of the Alleged Violation of the Convention And Relevant Arguments The applicants observe that the Republic of Georgia had ratified the Convention (1) prior to the date the prosecution against them commenced. The European Court of Human Rights is competent ratione temporis, ratione personae, ratione loci and ratione materiae.
The applicants are victims of arbitrary and illegal persecution, conviction and punishment. This case involves several momentous violations of Georgian national law and fundamental principles of law as cited in the European Convention of Human Rights. The judgments of the domestic courts were also based upon unlawful evidence and obvious misinterpretation of law as well as upon incredible ignorance of facts and law.
